Welcome to High Tea with Harriet ("High Tea with Harriet", "we", "us", "our"). These Terms & Conditions govern your access to and use of our website and online store, and your purchase of our products and services (together, the "Services").

Our store is hosted on Shopify, which provides the ecommerce platform. All sales are made directly by High Tea with Harriet.

By accessing the Services or purchasing from us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Agreement

By using our website or purchasing from us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

Accounts

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and all activity on your account. Accounts may not be transferred or licensed to another person.

Products & Content

We make every effort to represent products accurately, but colours and finishes may vary due to device settings and manufacturing tolerances. We may change descriptions, pricing, availability, or discontinue products without notice.

Orders

Your order is an offer to buy. We accept only when we send an order confirmation after successful payment authorisation. We may cancel or refuse an order (for example, suspected fraud, error, or stock issues). If cancelled after payment, you will be refunded.

Products are for personal and household use only; no resale or export without our consent. International orders may be subject to customs inspections or delays outside our control.

Prices, Taxes & International Orders

All prices are in AUD.

Australia: Prices include GST where applicable.
International: Prices exclude import duties, taxes, and customs or clearance fees, which you are responsible for paying.

Shipping and handling are shown at checkout. Promotions may have separate terms; if there is a conflict, promotion terms prevail. You authorise us to charge your selected payment method and warrant you are authorised to use it.

Shipping & Delivery

See our Shipping Policy for rates, destinations, and timeframes. Title and risk pass on delivery, subject to your rights under the Australian Consumer Law (ACL).

Returns & Refunds

See our Returns & Refunds Policy. Nothing in these Terms limits your ACL rights, including guarantees that goods are of acceptable quality and fit for purpose.

Gift Cards

Gift cards (digital or physical):

Are issued in AUD and redeemable only on our online store;
Are valid for at least 3 years from issue (expiry shown);
Are not refundable, reloadable, or redeemable for cash (except as required by law);
Cannot be used to buy other gift cards;
Will not be replaced if lost or stolen.

Intellectual Property

All site content (text, images, graphics, designs, logos, code) is owned by us or our licensors and is protected by intellectual property laws. You may use the site for personal, non-commercial purposes only. No reproduction, distribution, modification, or derivative works without prior written consent.

Reviews & Feedback

By submitting reviews, images, or suggestions, you grant us a worldwide, royalty-free, perpetual, sublicensable licence to use and publish them for marketing and service improvement. You warrant you own or have rights to your content and that it is lawful and accurate. We may moderate or remove content at our discretion.

Acceptable Use

You must not use the Services to break the law or infringe rights; post unlawful, defamatory, obscene, or misleading content; upload malware or interfere with security; or scrape, crawl, or harvest data without consent. We may suspend or terminate access for breach.

Shopify’s Role

Our store runs on Shopify’s platform. Shopify is not a party to your purchase and is not responsible for our products, fulfilment, or customer support.

Warranties, ACL & Liability

Our goods come with guarantees under the Competition and Consumer Act 2010 (Cth) that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not major.

Except for your ACL rights and any express warranties, the Services and content are provided “as is” and “as available.” To the extent permitted by law, we exclude liability for indirect or consequential loss. Where liability cannot be excluded, it is limited (at our option) to repair or replacement of goods or the cost of doing so, unless a major failure applies.

Privacy

We handle personal information in accordance with our Privacy Policy. Shopify also processes certain data — see Shopify’s Privacy Policy.

Termination

We may suspend or terminate your access if you breach these Terms. Sections that by nature survive (IP, Feedback, ACL, Liability, Privacy, Governing Law) remain in effect.

Boilerplate

Severability: If any part of these Terms is found unenforceable, the rest remains valid.
Waiver: Our failure to enforce any provision is not a waiver of our rights.
Assignment: You may not transfer your rights or obligations under these Terms without consent. We may assign ours without restriction.
Entire agreement: These Terms and referenced policies are the full agreement between you and us.

Changes

We may update these Terms by posting a new version on this page. Material changes will be notified as required by law. Continued use after changes means acceptance.
